Recently in Florida, one of the largest settlements under the False Claims act has been reached. Steven J. Wasserman, a dermatologist has agreed to pay over $26 million to resolve allegations against him. He was accused of entering an illegal kickback arrangement and performing unnecessary procedures on patients and billing Medicare for them.
What is The False Claims Act?
The False Claims Act is a law that places liability on anyone or any business that defrauds any governmental program. This act includes a provision called the qui tam (commonly called the whistleblower). This provision enables a party to file a suit on behalf of the government if they are aware of some form of fraudulent behavior. The party that files this suit then becomes entitled to some of the settlement that is reached. In the case mentioned above, the claim was filed by Alan Freedman M.D, a pathologist who formerly worked at the firm that Dr. Wasserman had entered into a kickback agreement with. Dr. Freedman will receive over $4 million from the settlement.
